This may be dealt with in either the Magistrates’ Court or the Crown Court.
The Magistrates’ Court must disqualify for at least 12 months and can sentence up to a maximum 6 months imprisonment.
The Crown Court can sentence up to 2 years imprisonment.
Both Courts must order that an extended re-test is taken.
